overlapping 2 closed ways results in multipolygon or normal merge building

I have two building, which overlaps and i want to merge them with the menu tool entry "überlappende Flächen verbinden" (meaning connect operlapping areas).

When i use the command, in some case i have one merged buildung, but the same two buildings will be merged as a multipolygon, even there is no real hole. The area, where both buildings are over each other, will then be the inner hole. I havn't found any systematic, when the merge is correct and when the wrong multipolygon will be created. The order, which building i first select, seems not to be relevant for the malfunction.

This error seem to be relative new. Two collegues found it out and i agree with the error.
