Merge selection: No warning with layer state `upload="never"`

What steps will reproduce the problem?

1. Have two identical data layers, one with state upload="false" one with upload="never" and a new, empty layer
2. Select an object in both layers and merge each to the empty layer with "merge selection"

What is the expected result?

Both times a warning about the different state or even a stronger restrictions for upload="never"

What happens instead?

A warning for upload="false" but no warning or restriction for upload="never"

Please provide any additional information below. Attach a screenshot if possible.

With "Merge layer" the state is merged, too, but with "Merge selection" it is not.
