I think this is because tunnel=yes does not imply, for example, layer=-1. It is unclear to me if there is a consensus on whether it should be implied: ​http://wiki.openstreetmap.org/wiki/Talk:Key:layer

For now, though, it seems the validator's complaint is legitimate, and it can't hurt to include an explicit layer tag.

Is this tunnel really layer=-1 otherwise it will also work if the tunnel and the buildings share nodes. I do not know if the tunnel is a real tunnel or just going through the building at layer=0. The nodes might even get a tag barrier=sally_port or something like that.

or you set layer=1 on the building.

Validator always wants to have a layer set. By the way the way has totally changed.
