you could use something like tangogps does:
in tangogps you can add your own map sources manually (like OSM, OpenAerial...); you just have to add an url like "http://tile.openstreetmap.org/%d/%d/%d.png" for example
it's not their fault if anyone were to try and type in a random url that happens to be the same as the one google uses.....
it's just like building a webbrowser;
you can't be responsible for the url's people will surf to
i see no copyright problems; only more openness

I work in an Open Source offline map viewer we get all the tile images from Google maps (Maps, Satellite & Terrain) this same functionality can be added to JOSM
In many places the google imagery is better than yahoo this could be very helpful

JOSM is not an offline map viewer, it is an editor! The ability to have Google Maps images in JOSM will most likely lead to misuses, because it's copyrighted material and users will ignore this fact, because they can easier map.
If you need to compare maps use sautter.com, tools.geofabrik.de or whatever.

In fact JOSM can display Google Maps nowadays. Write you own Javascript code which creates a image like the code for Yahoo does and set it in WMS prefs. Works fine, but we wont add such things as default or easy accessable.

"we wont add such things as default or easy accessable". THis also means we wont tell in a bug tracker.

We are not allowed to use Google's aerial (or satellite) images for tracing. That that is found traced from Google will have to be removed. Do not use *any* GMaps service when producing data for OSM.

FWIW, one with technical knowledge on server administration can easily achieve this by building a reverse proxy that links to Google Maps tiles service
No. We are not allowed to use Google Maps and this would result in copyright problems.
