Tagging-preset-tester-plugin not available without data layer

What steps will reproduce the problem?

1. Install tagging-preset-tester-plugin
2. restart JOSM
3. look for the the plugin in menus

What is the expected result?

Find the item in some menu

What happens instead?

The item is hidden under "Presets" which is inactive without data layer.

Please provide any additional information below. Attach a screenshot if possible.
