Merge Overlapping Areas - Conflict Dialog displays even if no conflicts

JOSM Rev 4223 - with both boxes checked in dialog.

The dialog displays with the message -

"No conflicts to resolve" and force a mouse click to continue (On OS X return key does not work in dialog either)

Please provide osm file with areas to merge.
