cannot combine several ways if part of them form a ring — at Version 1

If I have 3 ways, two of them form a ring and the third one is connected at the connection of the other two, I cannot combine them when all are selected (Error message), but if I select one of the ring and the other one, combine them, and then select the remaining one of the ring, Josm will combine all 3.
(In the attached screenshot, the ring is up-left (sorry, the white label might be confusing))
