I've just encountered a conflict while trying to upload my changes. Since I did only small changes and didn't want to interfere with the other user doing changes, I've deleted the whole data layer (thus effectively throwing away my own changes). After downloading the area again, josm still shows the conflict and wouldn't let me upload new changes (that don't conflict themselves).
