Transparent WMS images

Description
I use a local WMS server to import some data. I created a transparent layer with MapServer with the following settings:
OUTPUTFORMAT NAME aggpng24 DRIVER AGG/PNG MIMETYPE "image/png" IMAGEMODE RGB EXTENSION "png" TRANSPARENT ON END
I see that the tiles from the WMS server comes transparent, but in JOSM images are displayed on a black background. If you add WMS layer over the API layer, it becomes completely invisible.
