Footway overlapping building multipolygon not noticed

In the attached screenshot and datafile a footway overlaps a building that is an outer of a multipoly (also erroneously tagged as building=yes). Yet, the validator doesn't notice the mistake and creates no warning for road overlapping building.

The crossing ways are correctly detected with r7891, it must have been fixed in the meanwhile.
